Managing Rotating Shifts and Schedules: A Legal Guide for SMEs
What a rotating shift is
A rotating shift is one where the worker alternates morning, afternoon and, where applicable, night shifts according to a pre-set schedule (cuadrante). It is common in hospitality, healthcare, industry and retail. Organising work in shifts does not exempt you from the Workers Statute rules on working time and rest.
Notice and publishing the schedule
The collective agreement usually sets the notice period for communicating the schedule. As good practice, publish shifts well in advance and keep written evidence of any change. A unilateral, last-minute change can amount to a substantial modification of conditions (Article 41 of the Workers Statute) if it has a relevant impact.
Mandatory rest periods
- Rest between shifts: at least 12 hours between the end of one shift and the start of the next (Article 34.3). This constrains moving from an afternoon shift to a morning one.
- Weekly rest: a minimum of one and a half uninterrupted days (36 hours), which may be accumulated over periods of up to 14 days.
- Rest within the shift: 15 minutes if a continuous shift exceeds 6 hours.
Night work
Work between 10 p.m. and 6 a.m. is considered night work. Night workers' hours cannot exceed an average of 8 per day over a 15-day reference period, and they may not work overtime. It usually carries a night premium under the collective agreement.
When designing rotations, avoid chaining a late-night close with an early-morning open: it would break the 12-hour rest.
Shift-based time tracking
The time-recording duty under Article 34.9 and Royal Decree-law 8/2019 also applies to rotating shifts. It must reflect the real start and end of each shift, breaks and hours actually worked, and be kept for four years.
